Welcome to the websites of Direct Sound, LLC (“Direct Sound,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of our websites — including www.DirectSoundProAudio.com and www.ExtremeHeadphones.com (collectively, the “Sites”). By visiting or using our Sites, you agree to these Terms and our Privacy Policy.

1. About Direct Sound

Direct Sound designs, manufactures, and sells professional isolation headphones, microphones, and audio accessories. Products are offered through our Sites, directly, or through authorized resellers and distributors.

2. Acceptance of Terms

By accessing or using the Sites, you accept these Terms and any updates that may be posted from time to time. We may revise these Terms to reflect changes in our business, legal requirements, or website features. When we do, we will update the “Effective Date” above. Continued use of the Sites means you accept the updated Terms.

3. Privacy and Data Use

Your use of the Sites is also governed by our Privacy Policy. We collect limited personal and technical information necessary to process orders, administer warranties, and improve your experience.

If you register a product or subscribe to communications, you consent to receive electronic messages from Direct Sound. You can opt out of marketing emails at any time.

Direct Sound complies with applicable privacy laws, including the General Data Protection Regulation (GDPR) and California Consumer Privacy Act (CCPA/CPRA), regarding data collection, use, and retention.

When you visit our Sites or contact us by email, you are communicating with us electronically. You consent to receive electronic communications from Direct Sound and agree that all agreements, notices, and disclosures we send electronically satisfy any legal requirements for written communication.

5. Eligibility and Children

Our Sites are intended for use by adults. We do not knowingly collect personal information from children under 13. If you are under 18, you may use our Sites only with the consent and supervision of a parent or guardian.

6. Your Account

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately if you believe your account has been compromised. Direct Sound is not responsible for losses arising from unauthorized access to your account.

7. Permitted Use

You are granted a limited, non-exclusive, revocable license to access and use our Sites for lawful purposes.
You agree not to:

  • Use the Sites for fraudulent or unlawful activity

  • Interfere with the security or functionality of the Sites

  • Reverse-engineer, copy, modify, or resell any Site content

  • Use automated tools (scrapers, bots, etc.) without permission

All content, including text, graphics, logos, and product images, is owned by Direct Sound or its licensors and protected by copyright and trademark laws. You may not use any Direct Sound trademarks, product names, or images without prior written permission.

8. Links and Third-Party Services

Our Sites may link to or integrate with third-party platforms such as payment processors, analytics tools, or social media. We do not control or endorse these external sites and are not responsible for their content or practices. Your use of third-party services is subject to their own terms and privacy policies.

9. Confidentiality

All content, data, and materials available on the Direct Sound websites, including text, images, logos, and downloadable resources, are proprietary and confidential to Direct Sound, LLC. Users agree not to reproduce, share, or distribute this material for any commercial purpose without written permission from Direct Sound.

10. Returns, Repairs, and Refunds

For returns, repairs, and refunds related to product purchases, please refer to our Warranty and Return Policy. Do not rely on this Terms of Use document for purchase-related rights; this section exists only to direct you to the correct policy.

11. International Use

The Sites are operated from the United States. If you access them from another country, you are responsible for complying with all local laws. You may not use or export any content in violation of U.S. export laws and regulations.

12. Indemnification

You agree to indemnify and hold harmless Direct Sound, its affiliates, employees, and agents from any claim, loss, or damage (including attorney’s fees) arising from your use of the Sites, your violation of these Terms, or your infringement of any third-party rights.

13. Disclaimer of Warranties

The Sites and their content are provided “as is” and “as available.” Direct Sound makes no warranties, express or implied, regarding the Sites or any linked content,  including, without limitation, warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Sites will be uninterrupted, error-free, or secure.

14. Limitation of Liability

To the fullest extent permitted by law, Direct Sound is not liable for any indirect, incidental, special, or consequential damages, including loss of data, profits, or business, arising from your use or inability to use the Sites. Our total liability to you for any claim related to your use of the Sites will not exceed one hundred dollars ($100). Some jurisdictions do not allow certain limitations of liability. In those cases, these limitations apply only to the extent permitted by law.

15. Dispute Resolution and Arbitration

Any dispute arising from these Terms will be resolved through binding arbitration under the Federal Arbitration Act, administered by the American Arbitration Association in St. Louis County, Missouri.

Arbitration will be conducted on an individual basis, class actions are not permitted. The prevailing party is entitled to recover reasonable attorney’s fees and costs. This clause survives termination of these Terms.

16. Termination

We may suspend or terminate access to the Sites, in whole or in part, at any time and without notice, for any reason, including misuse or violation of these Terms. You may stop using the Sites at any time. Termination does not affect any legal obligations that have already accrued.

17. Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any permitted court proceedings related to arbitration enforcement or injunctive relief shall take place exclusively in St. Louis County, Missouri.
